Consent to Pet Brush, Blowout, Haircuts, and Coloring Services & Release of Liability

 This contract is between Bark&Brush Studios, LLC (the “Company”) and the individual signing below (the “Owner”) as of the date of signing. By signing this agreement, the Owner agrees to the following terms regarding the services provided by the Company.

  1. Current Vaccinations/Veterinarian Information:

The Owner verifies that their pet is up to date on all vaccinations and that the pet is healthy to the Owner’s knowledge. The Company reserves the right to refuse services to any pet showing signs of illness, injury, or other conditions that may pose a risk to the pet, other animals, or staff. As lawful consideration for being permitted by the Company to participate in the Services, Owner agrees to the terms and conditions set forth in this release (“Release”). In addition, Owner agrees to abide by all policies and procedures established by the Company in relation to the Services.

  1. Allergies, Collars, Be On-Time:

Owner is solely responsible for disclosing to the Company the existence of all pets in the home and any pet allergies, illnesses, health conditions, habits or behaviors (e.g. aggressiveness, biting, escaping and favorite hiding places) that could potentially impact the Company’s provision of the Services or the safety of any personnel; and

Owner must provide any necessary items, such as leashes, well-fitting collars, and medications, required to complete the service safely; and

Owner must ensure their pet arrives on time for the scheduled appointment. Delays beyond 15 minutes may result in rescheduling or a late fee; and

  1. Services Provided

The Company offers the following services:

  • Bath, Brush & Blowout (BBB): A luxurious grooming session to clean, detangle, and freshen up your pet’s coat.
  • BBB with Haircut: Includes trimming and styling for a polished look.
  • Creative Coloring: Pet-safe, vibrant coloring services, including partial or full-body transformations.
  • DeShedding Treatments: Designed to reduce shedding and promote a healthier coat.
  • Additional Styling Add-Ons: Nail polish, accessories, or custom styling upon request.

Matting and Coat Conditions:

  • Pets with excessive matting or coat issues may require additional time and effort. The Owner agrees to pay an additional fee for de-matting services, if required, or accept that the pet may need to be shaved for its comfort and safety.
  • The Company will not be liable for minor skin irritations or hair regrowth issues resulting from de-matting or shaving services.
  1. Creative Coloring Services – Risks and Expectations:

Owner acknowledges and accepts that dog coloring services involve the use of pet-safe, non-toxic, semi-permanent products, which may last between 4-20 washes depending on the coat type and maintenance practices. The Owner agrees to the following specific terms related to coloring services:

Coloring Process: The Company uses pet-safe coloring products specifically designed for animals, and every precaution is taken to ensure the safety and comfort of the pet during the process. However, coloring results may vary based on the breed, coat type, and condition of the pet’s hair.

Potential Risks: While the coloring products are non-toxic and safe, individual pets may have sensitivities or allergic reactions that cannot always be predicted. Owner understands that possible risks may include, but are not limited to, skin irritation, allergic reactions, and changes in behavior post-service (e.g., scratching or licking).

Maintenance & Aftercare: The Company will provide aftercare instructions to help maintain the color and prevent fading. Owner acknowledges that improper care, frequent washing, swimming, or exposure to outdoor elements (e.g., rain, chlorinated pools, sun exposure) may cause the color to fade or wash out more quickly than expected. The Company does not guarantee the longevity of the color post-service.

Pre-Existing Conditions & Matting: Owner is responsible for disclosing any skin conditions, matting, or sensitivities their pet may have. Heavily matted fur may need to be trimmed or shaved before coloring, which may cause minor skin irritation or hair regrowth issues.

Custom Designs: If the Owner requests custom designs (e.g., specific patterns or themes), they agree to provide detailed instructions beforehand. The Company will make every reasonable effort to achieve the requested design, but the final result may vary based on the pet’s coat and temperament.

Dark-Furred Dogs: For dogs with black or dark fur, certain creative coloring services may require the use of a lightening or developer process to achieve vibrant results. The Owner acknowledges and agrees to the following:

Additional Cost and Time: Lightening dark fur involves extra time, effort, and product. A flat fee of $25 will be applied for this service. This charge covers the additional materials and extended appointment duration required to complete the process safely.

Process and Safety Measures:

  • A small test area will always be performed first to ensure the dog’s skin tolerates the process without adverse reactions.
  • For longer processes, dogs will be given breaks as needed to ensure their comfort and reduce stress.

Potential Risks: While the products used are specifically formulated for pets and meet safety guidelines, the Owner acknowledges that lightening fur carries inherent risks, including but not limited to:

  • Skin sensitivity or mild irritation, such as redness or itching.
  • Temporary dryness or changes in the fur texture.
  • The need to shave or trim fur in rare cases where matting, irritation, or fur damage occurs. 
  1. Payment:

All payments are collected after services are performed and are non-refundable. If the total amount paid exceeds the Services used for a period, the overage will remain as a credit with Company for a period of twelve (12) months and can be used for future Services.

The Company accepts all major credit and debit cards, cash app, and PayPal. Company maintains the card on file and prepares a weekly statement, sent to the Owner and billed to the card each week following the close of the billing period. Owner is requested to review the statement within 48 hours and report any discrepancies to Company.

A finance charge of ten percent (10%) per month will be added to unpaid balances after fifteen (15) days. If payment is not received within ninety (90) days from close of associated billing period, the Company reserves the right to send such unpaid invoice(s) to collections. An insufficient funds fee of $35.00 will be assessed for any returned check or insufficient funds notification from bank.

  1. Cancellation Policy:

Owner must notify the Company of Service cancellation at least 48 hours before the scheduled visit. If canceled between 24-48 hours, the Owner will be billed $25 for late cancellation. If canceled within 24 hours, the Owner will automatically be billed for the Service(s) as scheduled, and the amount billed will be put on the Owner’s account as a credit for future Service(s). More than 3 violations of this policy will result in forfeiture of any credits and termination of the relationship, except in cases of verified emergencies (e.g., veterinary appointments or family emergencies).

  1. Satisfaction Guarantee and Refund Policy

Our mission is simple: to create transformations that make Owner’s pups stand out. We believe Owner’s dogs should leave their session looking so stylish and adorable that Owners can’t resist capturing endless photos! But sometimes art can be subjective and what looks great to one person can look bad to another. We do our best to devise a coloring plan with every owner, prior to start of sessions.

If for any reason Owners are not completely satisfied with their pet’s look, we promise to make it right. Whether it’s adjusting the color, refining the style, or offering advice on maintenance, we are committed to ensuring that both Owners and their pups leave with smiles and plenty of Instagram-worthy moments.

We pride ourselves on offering a personalized, luxurious experience for every dog—because Owner’s pups deserve nothing less than the best. It’s all about style, care, and making sure both Owners and their dogs have a memorable experience.

While we strive to create a picture-perfect experience for every dog, we understand that adjustments may sometimes be necessary. In the event that Owners are not fully satisfied with the results, we do not offer refunds because of product and labor cost, but are committed to making it right by providing credits for future services or offering complimentary adjustments to ensure satisfaction.

Our goal is to ensure that both Owners and their dogs leave happy, and we will work with Owners to achieve the perfect outcome. Whether it’s refining the color or offering additional styling, we are dedicated to providing solutions that meet Owners’ needs.

Non-Disparagement Clause: The Owner agrees to communicate any concerns or dissatisfaction directly to the Company in a constructive manner, allowing the Company the opportunity to address and resolve the issue. The Owner further agrees not to post or share negative comments, reviews, or feedback about the Company, its services, or employees on social media platforms, review sites, or other public forums without first allowing the Company the opportunity to rectify the issue. This ensures a fair process for resolution and preserves the professional reputation of the Company.

Our goal is to ensure that both Owners and their dogs leave happy, and we will work with Owners to achieve the perfect outcome. Whether it’s refining the color or offering additional styling, we are dedicated to providing solutions that meet Owners’ needs.

  1. Aggressive or Dangerous Pets:

Owners MUST inform the Company if Owner’s pet has bitten, or is aggressive to people, other pets or specific grooming procedures. Muzzles may be used if necessary for grooming services. Muzzling will not harm Owner’s pet and protects both the pet and the groomer.

The Company reserves the right to refuse/stop Services for pets at any time before or during the Services if it is determined in the Company’s sole discretion that the pet(s) pose a danger to the health and safety of itself, other pets or other people. The Company reserves the right to charge a handling fee for aggressive pets in addition to the regular grooming charge.

If the pet should bite, the Owner agrees to be responsible for any and all related medical bills, recovery costs, loss of income and equipment damage. The Owner authorizes Company to use all means reasonably necessary, in Company’s sole discretion, to keep the Owner’s pet(s) safe and healthy while providing the Services.

  1. Health, Medical Problems & Senior Pets:

The Services can sometimes be stressful, especially for a senior or ill pet. The Services can also expose hidden medical problems or aggravate a current one during or after the groom. Because these pets have a greater chance of injury, they will be groomed for cleanliness and comfort. In the best interest of Owner’s pets this Release will give the Company permission to obtain immediate medical treatment for Owner’s pet should it be deemed necessary by the Company.

We will make reasonable attempts to contact Owner prior to seeking such medical treatment. It is agreed that all expenses for medical care will be covered by the pet’s Owner. Owner authorizes the Company to obtain necessary medical treatment for Owner’s pet in the event of such injury or illness and Owner release and hold harmless the Company subsidiaries, officers, directors, managers, employees, agents, affiliates, shareholders, members, successors, and assigns, including any and all subsidiaries, affiliations, or other entities controlled directly or indirectly by Company in Owner’s pet’s treatment. Owner further agrees that Owner is solely responsible for any and all necessary medical treatment and bills in the event of any illness or injury during the Services.

  1. Release of Claims & Indemnification:

THERE IS ALWAYS THE POSSIBILITY THAT AN ACCIDENT COULD OCCUR. THE EQUIPMENT USED IN PROVIDING THE SERVICES IS SHARP, EVEN THOUGH WE USE EXTREME CAUTION AND CARE IN ALL SITUATIONS, POSSIBLE INJURIES COULD OCCUR INCLUDING CUTS, NICKS, SCRATCHES, QUICKING OF NAILS, ETC. OWNER HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS WHICH OWNER MAY HAVE, OR WHICH OWNER MAY HEREAFTER HAVE, WHETHER KNOWN OR UNKNOWN, AGAINST THE COMPANY, AND ITS SUBSIDIARIES, OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, SHAREHOLDERS, MEMBERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASEES”), ON ACCOUNT OF INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE SERVICES OFFERED BY THE COMPANY WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF THE COMPANY OR ANY RELEASEES OR OTHERWISE. OWNER COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST THE COMPANY OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE THE COMPANY AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. THIS WAIVER AND RELEASE DOES NOT EXTEND TO CLAIMS FOR GROSS NEGLIGENCE, INTENTIONAL OR RECKLESS MISCONDUCT, OR ANY OTHER LIABILITIES THAT ARIZONA LAW DOES NOT PERMIT TO BE RELEASED BY AGREEMENT.

OWNER SHALL DEFEND, INDEMNIFY, AND HOLD HARMLESS THE COMPANY AND ALL OTHER RELEASEES AGAINST ANY AND ALL LOSSES, DAMAGES, LIABILITIES, DEFICIENCIES, CLAIMS, ACTIONS, JUDGMENTS, SETTLEMENTS, INTEREST, AWARDS, PENALTIES, FINES, COSTS, OR EXPENSES OF WHATEVER KIND, INCLUDING ATTORNEY FEES, FEES AND THE COSTS OF ENFORCING ANY RIGHT TO INDEMNIFICATION UNDER THIS RELEASE, AND THE COST OF PURSUING ANY INSURANCE PROVIDERS, ARISING OUT OF OR RESULTING FROM ANY CLAIM OF A THIRD PARTY RELATED TO MY PARTICIPATION IN THE SERVICES, INCLUDING ANY CLAIMS ARISING OUT OF OWNER’S OWN NEGLIGENCE OR THE ORDINARY NEGLIGENCE OF THE COMPANY.

  1. Consent to Use Photos:

Owner hereby grants the Company, without limitation, the right to use their pet’s name and likeness in connection with the Services for promotional purposes, including social media, advertisements, and marketing materials, without further compensation or permission. The Company agrees not to use identifying information about the Owner without explicit consent.

  1. Parasites:

If fleas or ticks are found during the provision of grooming services, the Owner’s pet will receive a flea bath to kill the parasites, and an extra charge will be applied. Severe infestations may result in refusal of service to ensure the health and safety of all pets and staff. Ticks found will be removed, and an additional charge may apply. Please note that parasites are a health hazard to Owner’s pet as well as to humans.

  1. Miscellaneous:

Owner understands that by signing this Release, Owner is waiving any and all claims, of any kind arising out of or attributable to Owner’s participation in the Services, including those claims that may be unknown to Owner, or which Owner does not suspect to exist at this time. This Release constitutes the sole and entire agreement of the Company and Owner with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.

If any term or provision of this Release is held invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Company and Owner and their respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Arizona without giving effect to any choice or conflict of law provision or rule (whether of the State of Arizona or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Maricopa County, Arizona and Owner hereby consents to the exclusive jurisdiction of such courts.

Company is not responsible for Owner’s failure to provide requested information and/or incorrect information about Medication, Allergies, or other important information relevant to the dog’s experience.

OWNER MUST ACKNOWLEDGE THAT THEY HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT OWNER IS VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY FOR CLAIMS, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF OWNER’S PARTICIPATION IN THE SERVICES.
